Approve Minutes from last meeting

1.

In the matter of approving the Minutes from the June 22, 2021 Business Meeting. - BOCC

Background: Approve the Minutes which summarize all business by the Board of Commissioners for the Business Meeting held on the date stated above.

Fiscal Impact: None

Recommended Motion: Approve the Minutes as presented. 

5.

Bids/Awards/Proposals

1.

In the matter of the BOCC accepting and approving the bid from Diversified Contractors to remodel the first floor Courts office area of the Courthouse. Glen Gregory, Maintenance

Background:  Maintenance issued an Invitation to Bid (ITB) for the remodel of the first floor Courts office area of the Courthouse.  Only one contractor submitted a bid.  The County entered into an agreement with the Oregon Judicial Department (OJD) for the OJD to reimburse the County $127,377 for the cost of this project. When the bid came back, OJD authorized reimbursement for the $140,267 and any additional costs up to $250,000.00.

Fiscal Impact:  Fiscal impact is $140,267 from the Facilities Service fund reimbursed by the OJD.

Recommended Motion:  Motion for acceptance of a bid from Diversified Contractors to remodel the Courthouse first floor Courts office area at 316 Main Street, Klamath Falls, OR. with a fiscal impact expenditure from the Facilities Service fund in the amount of $140,267 (with a reimbursement of $140,267 and any additional costs up to $250,000.00 from the OJD).

Orders

In the matter of appointing Hallie Williams to the Developmental Disabilities Advisory Board. - BOCC

Background: The Developmental Disabilities Advisory board has a vacancy and has recommended the appointment of the above named individual who is willing, able and eligible to serve a term on the Board.

Fiscal Impact: None.

Recommended Motion: Approve and sign the attached Order appointing Hallie Williams to the Developmental Disabilities Advisory Board.


7.

Budget Resolutions

1.

In the Matter of the Adoption of a Budget Resolution within the General Fund Tax Collector and the Equipment Reserve Fund. Vickie Noel - Finance

Background:  This resolution decreases Material and Services and increases a transfer to the Equipment Reserve fund from the General Fund – Tax Collector department of $35,000.00.  It also records the transfer into Equipment Reserve from Tax and budgets for the transfer from the Juvenile reserve to Finance for the purchase of a 2007 Ford Explorer.

Fiscal Impact:  $35,000.00 transfer between General fund and Equipment Reserve fund.

Recommended Motion:  The Board of Commissioners of Klamath County, Oregon hereby approve the Budget Resolution for fiscal year 2020-21 as outlined in the attached documents for changes to General Fund Tax Collector and the Equipment Reserve Fund. Fiscal impact is a $35,000.00 transfer between General fund and Equipment Reserve fund.

Agreements

1.

In the matter of approving Agreement #169517 Intergovernmental Agreement (IGA) for Financing of Public Health Services between the State of Oregon, Oregon Health Authority (OHA), and Klamath County, acting by and through Klamath County Public Health (KCPH). – Jennifer Little, Public Health

Background:  Agreement 169517 delegates authority to Klamath County Public Health to operate public health programs in Klamath County. The agreement outlines the individual program element (PE) descriptions by which programs are operated and also outlines the Financial Assistance Award through June 30, 2022. The agreement is effective July 1, 2021 through June 30, 2023.   


Fiscal Impact:  Fiscal impact is grant revenue of $935,792 for FY 21/22.  


Recommended Motion:  Move to approve Agreement #169517 Intergovernmental Agreement (IGA) for Financing of Public Health Services between the State of Oregon, Oregon Health Authority (OHA), and Klamath County, acting by and through Klamath County Public Health (KCPH). Fiscal impact is grant revenue of $935,792 for FY 21/22. Authorize the Department Head to sign the agreement.

In the matter of approving a continuing intergovernmental agreement with Lake County for the fiscal year 2021-22 placement of Lake County youth in the Klamath County Juvenile Detention Home (JDH).-Dan Golden, Director

BACKGROUND & CONCLUSIONS:  Klamath County agrees to provide a minimum of 220 bed days to Lake County. Lake County agrees to pay $110.00 per day for bed days used. The agreement specifies that Lake County will pay Klamath County for the minimum of 220 bed days for the fiscal year.  

FISCAL IMPACT:    Potential minimum revenue for the Juvenile Department of $24,200.00.

RECOMMENDED MOTION:   Approve the Intergovernmental Agreement between Klamath County and Lake County for Fiscal Year 2020-21. Potential impact of a minimum revenue for the Juvenile Department of $24,200.00.

Public Hearings

1.

TIME CERTAIN 8:45am - In the matter of holding the public hearing on the proposed petition to annex properties into the Crescent Sanitary District submitted by Allen and Patricia Putman-BOCC

Background: The Board of Commissioners received an annexation petition on May 26, 2021. The legal description and maps of the property to be annexed are attached as Exhibit A.  Per ORS 198.857, the Board is required to hold only one hearing on the matter as the petition is signed by the current landowner and has been endorsed by the District Board (see Exhibit B).


Fiscal Impact: There is no fiscal impact to the County; publication costs will be paid by the district and/or the petitioner.


Recommended Motion:  Hold the public hearing on the proposed petition for annexation for public comment. There is no fiscal impact to the County; publication costs will be paid by the district and/or the petitioner.

Order annexing the property shown on Exhibit A into the Crescent Sanitary District-BOCC

Background: The Board of County Commissioners held the public hearing on this matter today, June 29, 2021 @ 8:45 a.m. for the taking of testimony and consideration. The attached Order approves the annexation request submitted by Allen and Patricia Putman into the Crescent Sanitary District.


Fiscal Impact: None 


Recommended Motion: The Board of County Commissioners approves the petition for annexation and signs the attached Order annexing the property shown in Exhibit A into the Crescent Sanitary District. Fiscal impact: None.


2.

TIME CERTAIN 8:50AM - In the Matter of holding a public hearing on proposed supplemental budget resolutions for Klamath County budget for fiscal year 2020-2021. Vickie Noel - Finance

Background: The purpose of the hearing is to discuss the proposed supplemental budget resolutions for Klamath County’s budget for the fiscal year 2020-2021 as advertised.  Time certain 8:50 am.

Fiscal Impact:   $505.18 Expenditure to the Finance budget for advertising costs.

Recommended Motion:  Hold the hearing on the proposed supplemental budget of Klamath County for fiscal year 2020-2021. Fiscal Impact is $505.18 expenditure to the Finance budget.


2.1.

In the matter of Adopting a Supplemental Budget within the Commissioners Miscellaneous Grant Fund. Vickie Noel - Finance

Background:  The Board of County Commissioners signed an amendment with the State of Oregon for an additional business grant through the Coronavirus Relief grant No. 2515.  The Board also executed an IGA with SCOEDD to administer the distribution of these grant funds to local businesses impacted by the COVID19 pandemic.  These changes occurred after the adoption of the 2020-21 budget.

Fiscal Impact:  $603,000 increase to revenues and expenditures within the Commissioner’s Misc Grant Fund.

Recommended Motion:  Approve the supplemental budget for fiscal year 2020-21 as outlined in the attached document.  Fiscal impact is a $603,000 increase to revenues and expenditures within the Commissioner’s Misc Grant Fund.


2.2.

In the matter of Adopting a Supplemental Budget within the Public Works and County School Funds. Vickie Noel - Finance

Background:  During preparation of the 2020-21 fiscal year budget, it was unknown whether the Federal Government was going to authorize Secure Rural School payments, therefore, Public Works Federal Reserve and County School funds did not have a budgeted amount for SRS revenues.  The authorization did occur later in the fiscal year requiring a supplemental budget for the increase in revenues.  There are additional corrections in both budgets to bring other budgeted revenues in line with actual amounts. 

Fiscal Impact:  $3,024,366 revenue and expenditure increase in Public Works Federal Reserve, $1,482,789 revenue and expenditure increase in County Schools Fund.

Recommended Motion:  Approve the supplemental budget for fiscal year 2020-21 as outlined in the attached document.  Fiscal impact is a $3,024,366 revenue and expenditure increase in Public Works Federal Reserve, and a $1,482,789 revenue and expenditure increase in County Schools Fund.

2.3.

In the matter of Adopting a Supplemental Budget within the Tax Collector Transient Room tax fund, Tourism Competitive Grants, Museum and Fairgrounds Fund. Vickie Noel - Finance

Background:  During preparation of the 2020-21 fiscal year budget, Transient Room Tax Revenues were not expected to be received at a normal level due to the COVID 19 pandemic.  Actual revenues exceeded this projection requiring a change to all the funds that receive these revenues. 

Fiscal Impact:  $1,600,000 increase in revenues and expenditures to the Transient Room Tax fund, increase in revenues and expenditures of $119,000 to the Museum fund, $584,000 to the Fairgrounds fund, and $139,000 to the Tourism Competitive grants fund.

Recommended Motion:  Approve the supplemental budget for fiscal year 2020-21 as outlined in the attached document.  Fiscal impact is $1,600,000 increase in revenues and expenditures from the Transient Room Tax fund, increase in revenues and expenditures of $119,000 to the Museum fund, $584,000 to the Fairgrounds fund, and $139,000 to the Tourism Competitive grants fund.


2.4.

In the Matter of the Adoption of a Supplemental Budget within the Public Health Fund. Vickie Noel - Finance

Background:   This supplemental budget increases grant revenues and expenditures related to the COVID19 pandemic in most sub-departments throughout the Public Health budget.  It also increases revenues and expenditures in Environmental Health related to the DEQ project that ended in March.  More revenues were received in the current fiscal year than in the previous year.

Fiscal Impact:   $615,005.00 increase in revenues and expenditures in the Public Health Fund.

Recommended Motion: The Board of Commissioners of Klamath County, Oregon hereby approve the supplemental budget for fiscal year 2020-2021 as outlined in the attached documents for changes to the Public Health Fund. Fiscal impact is a $615,005.00 increase in revenues and expenditures.
